License Agreement, Warranty, and Disclaimer
By accessing the Space Environment Technologies (SET) Space Weather Alert Portal (SWAP), you agree to the following conditions. Be sure to read the following agreement before accessing these data. By entering the portal, you indicate your unconditional acceptance of the terms of this agreement. IF YOU DO NOT ACCEPT THE TERMS OF THIS AGREEMENT, DO NOT ACCESS OR USE THE SET SPACE WEATHER ALERT PORTAL.
These data are collected, managed, created and/or distributed by Space Environment Technologies (SET). They are protected Intellectual Property by United States copyright laws and international treaty provisions. Therefore, you must treat the data like any other copyrighted material (e.g. a book or musical recording). These data in the SET Space Weather Alert Portal are freely and publicly provided for the sole purpose of scientific research.
Commercial distribution and/or use of the data is prohibited without permission of SET. We are more than happy to allow you to distribute or use our data commercially, but you must first have a license to do so. Contact contracts@spacewx.com and request details for obtaining a commercial distribution and/or use license.
The rules of the road for use of these data are simple:
- scientific study use: this science use license is provided to a user for open access to the data, exclusively for scientific research use, and at no charge;
- derivative products generating revenue or funding opportunities: no license is provided herein for commercial use of these data; if you are interested in commercial use, SET will provide a separate commercial license and an agreement for you to do so; and
- publication or conference paper credit: these data were developed with SET IR&D funding; please acknowledge use of the data as “The SET Space Weather Alert Portal data are provided for scientific use courtesy of Space Environment Technologies.”
You may not rent, lease, or sell the data to third parties, nor may you modify, adapt, translate, reverse engineer, decompile, or disassemble the data. If you violate any part of this agreement, your right to use these data terminates automatically and you then must destroy all copies of it in your possession.
The data and related documentation are provided ‘AS IS’ and without warranty of any kind. SPACE ENVIRONMENT TECHNOLOGIES (SET) EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ANY WRITTEN OR ORAL INFORMATION OR ADVICE GIVEN BY SET, ITS AGENTS, DISTRIBUTORS, OR EMPLOYEES, SHALL NOT IN ANY WAY BE CONSTRUED AS GRANTING OR CREATING A WARRANTY. This Agreement shall be governed by the laws of the State of California. If for any reason a court of competent jurisdiction finds any provision of this Agreement, or portion thereof, to be unenforceable, that provision of the Agreement shall be enforced to the maximum extent permissible so as to effect the intent of the parties, and the remainder of this Agreement shall continue in full force and effect.
If you are a U.S. Government user, the data and documentation is provided with RESTRICTED RIGHTS as defined in Federal Acquisition Regulation 52.227.14. Use, duplication, or disclosure by the all users is subject to the restrictions above. The manufacturer is Space Environment Technologies.
All rights of Space Environment Technologies may be exercised or enforced.
